Please read these Terms of Service (“Terms”) carefully. By creating an account, purchasing a subscription, accessing the website, or using the DriveToPass application or services, you agree to these Terms. If you do not agree, do not use the Service.
1. About DriveToPass and these Terms
“DriveToPass,” “we,” “us,” and “our” mean the legal entity that operates the DriveToPass website, application, and related services. The operator’s current identity and contact details must be displayed in the application store listing and on our Contact page.
“You” means any visitor, registered user, learner driver, supervising driver, instructor, subscriber, or other person accessing the Service. If you use the Service for an organisation, you confirm that you are authorised to accept these Terms for that organisation.
We may update these Terms to reflect changes to the Service, law, safety requirements, or business practices. If a change materially affects your rights, we will provide reasonable notice where required by applicable law. The version in effect when you use the Service applies to that use.
2. The DriveToPass Service
The “Service” includes the DriveToPass website, mobile application, driving test-centre directory, route catalogue, route previews, sat-nav and map guidance, custom route recording, saved-route library, route sharing, route results, subscriptions, and associated content and support.
The Service is intended to support driving practice and preparation. It is not a driving school, driving instructor, examiner, emergency service, or official transport or licensing authority. DriveToPass is not affiliated with or endorsed by any national or local driving-test authority unless we expressly state otherwise.
Test routes may change and an examiner may select different roads. Use of the Service does not guarantee that a route will appear in a test, that you will pass a test, or that you will receive any particular result.
Some features, test centres, route content, languages, and subscription options may not be available in every country, region, device, or operating system.
3. Eligibility and local requirements
You must be legally capable of agreeing to these Terms. If you are below the age at which you can enter a binding contract in your location, a parent or legal guardian must approve your use and any purchase.
You are responsible for complying with all laws and requirements that apply where you drive, including minimum driving age, learner permits or licences, supervision, insurance, vehicle roadworthiness, seat belts, mobile-device restrictions, and any special conditions applying to learner drivers.
4. Driving safety and lawful use
Safety always overrides route guidance. Road signs, signals, closures, police or authorised directions, weather, traffic, pedestrians, other road users, and your own safe judgment take priority over anything shown or spoken by DriveToPass.
- Set up the route, destination, audio, and device mount before the vehicle moves.
- Do not hold, type on, look continuously at, or otherwise interact with a device while driving.
- Use an appropriate lawful mount and spoken guidance where permitted.
- Stop safely and legally before changing a route or resolving a navigation issue.
- Never follow an instruction that is unsafe, unlawful, inaccessible, restricted, or inconsistent with current conditions.
- Learner drivers must have the legally required supervisor, instructor, licence or permit, vehicle, and insurance.
Sat-nav and lane information is an aid only. It does not replace observation, mirrors, signalling, speed management, lane markings, road signs, or independent decision-making.
5. Accounts and account security
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your password, access tokens, device, and account activity. Do not share credentials or allow unauthorised access.
Tell us promptly if you suspect unauthorised use. We may require verification, restrict access, or suspend an account to protect users or the Service.
You may not create accounts using false identities, impersonate another person, evade restrictions, or use automated methods to create or control accounts.
6. Test routes, maps, sat-nav, and lane guidance
Route content may be created from multiple data sources and may be inaccurate, incomplete, delayed, or out of date. Roads, junctions, speed limits, lane layouts, access restrictions, and test-centre arrangements can change without notice.
Distance, duration, arrival time, lane guidance, manoeuvres, and route results are estimates. GPS accuracy depends on your device, signal, surroundings, permissions, and third-party mapping services. The Service may lose location or navigation functionality.
You must independently confirm that a road is public, open, suitable for your vehicle and licence, and lawful to use. DriveToPass is not responsible for fines, penalties, collisions, damage, delay, or loss caused by ignoring current road conditions or legal requirements.
7. Custom routes, recording, and sharing
Custom Routes are journeys that you record, create, save, or edit. A Custom Route may include coordinates, map geometry, route name, notes, distance, duration, speed-related information, timestamps, and other route metadata.
7.1 Your responsibilities
Only record a route when doing so is lawful and safe. Start and stop recording before moving or while safely parked. You must have the necessary rights and permissions to upload notes, names, or other content.
7.2 Privacy of route data
Route data can reveal homes, workplaces, schools, habits, and other sensitive locations. Review a route before sharing it. Do not record or share another person’s private location information without an appropriate lawful basis and permission.
7.3 Sharing access
When you share a Custom Route, authorised recipients may view and use the shared route. You are responsible for choosing recipients. Sharing controls may allow you to grant, update, revoke, or restore access, but we cannot control copies, screenshots, exports, or information retained by a recipient outside the Service.
7.4 Licence to operate the Service
You retain ownership of content you create. You grant DriveToPass a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, format, map, transmit, and display that content only as reasonably necessary to operate, secure, improve, and provide the Service and the sharing choices you make. This licence ends when the content is deleted, except for lawful retention, backups, dispute resolution, or content already shared outside our control.
8. Subscriptions, payments, and cancellation
Some features require payment or an active subscription. Prices, billing periods, included features, taxes, trial terms, and renewal details will be shown before purchase. Charges may be processed by an application store or other payment provider whose terms also apply.
Unless the purchase screen states otherwise, subscriptions renew automatically until cancelled. You must cancel through the platform used to purchase the subscription. Deleting the application or account may not cancel a subscription administered by an application store.
Refunds, withdrawal rights, and cancellation rights are governed by applicable consumer law and the rules of the payment platform. Nothing in these Terms limits mandatory consumer rights. See our Subscription and Cancellation Policy for additional information.
9. Intellectual property
The Service, excluding user-owned content, and its software, design, branding, databases, route presentation, text, graphics, and other materials are owned by or licensed to DriveToPass and protected by applicable intellectual-property laws.
We grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service for lawful, non-commercial driving practice in accordance with these Terms. You may not copy, sell, sublicense, scrape, reverse engineer, bypass access controls, build a competing route database from the Service, or commercially exploit any part of the Service except where applicable law expressly permits it.
10. Acceptable use
You must not use the Service to:
- break any local, national, or international law or assist unsafe or unlawful driving;
- upload malicious code or interfere with the Service, networks, security, or another user;
- access data or accounts without authorisation;
- harass, threaten, deceive, impersonate, discriminate against, or invade the privacy of another person;
- share content that is unlawful, defamatory, obscene, fraudulent, infringing, or harmful;
- collect route or location data about another person without lawful authority;
- overload, scrape, crawl, or automate access except with our written permission; or
- circumvent subscriptions, route permissions, technical protections, or usage limits.
We may remove content or restrict accounts where reasonably necessary to enforce these Terms, protect users, comply with law, or maintain safety and security.
11. Third-party services
The Service may depend on mapping, geolocation, authentication, analytics, cloud hosting, payment, application-store, and communication providers. Their terms and privacy practices may apply to your use of their functionality.
We are not responsible for third-party websites, services, content, outages, data, or actions that we do not control. Links do not imply endorsement.
12. Availability, changes, and updates
We may add, change, suspend, or discontinue features, routes, test centres, content, or device support. We do not guarantee uninterrupted, error-free, secure, or universally available access. Maintenance, connectivity, GPS, device settings, third-party services, and events outside our reasonable control may affect availability.
You are responsible for internet access, mobile data charges, compatible equipment, software updates, and device permissions required to use the Service.
13. Suspension and termination
You may stop using the Service at any time. Subject to applicable law and subscription-platform requirements, you may request account deletion through available account controls or by contacting us.
We may suspend, restrict, or terminate access where you materially or repeatedly breach these Terms, create a safety or security risk, misuse route sharing, fail to pay applicable charges, or where action is required by law. Where appropriate and legally required, we will provide notice and a reasonable opportunity to remedy the issue.
Termination does not affect accrued rights, payment obligations, lawful data retention, or provisions intended to continue, including intellectual property, disclaimers, liability limitations, and dispute provisions.
14. Disclaimers and limitation of liability
The Service is provided on an “as available” basis. To the maximum extent permitted by applicable law, we do not guarantee the accuracy, completeness, safety, availability, or fitness of any route, map, lane instruction, estimated result, test-centre information, or user-created content.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where such exclusion is prohibited.
To the maximum extent permitted by law, DriveToPass will not be liable for indirect, incidental, special, punitive, or consequential loss; loss of profits, opportunity, goodwill, business, or data; test failure; fines; or losses arising from unsafe or unlawful use, navigation errors, route changes, GPS failure, third-party services, or user content.
Where liability may lawfully be limited, our aggregate liability arising from the Service will not exceed the greater of the amount you paid to DriveToPass for the Service during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law.
Some jurisdictions do not permit particular exclusions or limitations. In that case, they apply only to the maximum extent allowed in your jurisdiction.
15. Responsibility for claims
To the extent permitted by applicable law, if you use the Service for business purposes or in breach of these Terms, you will be responsible for reasonable losses and claims arising from your unlawful use, infringement of another person’s rights, or content you upload or share. This provision does not apply where prohibited by consumer law.
16. Governing law, disputes, and international users
DriveToPass is offered to users in multiple countries. You must comply with the laws that apply in the place where you access and use the Service, particularly road traffic, mobile-device, privacy, consumer, and learner-driver laws.
These Terms should specify the law of the country in which the DriveToPass operating entity has its principal place of business. However, if you are a consumer, you retain any mandatory protections provided by the law of your country or region that cannot be waived by contract.
Before starting formal proceedings, you and DriveToPass should attempt in good faith to resolve the dispute through our support channel. A dispute may be brought before any court or dispute-resolution body that has jurisdiction under applicable law. These Terms do not require a consumer to bring a claim exclusively in another country where local law gives the consumer a right to bring it locally.
17. General provisions
If any provision is found unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer the Terms as part of a merger, reorganisation, sale, or transfer of the Service, subject to applicable law.
These Terms, together with the Privacy Policy, Subscription and Cancellation Policy, purchase terms, and any feature-specific terms presented to you, form the agreement relating to the Service.
